Will of George Mitchell 1791

Will of George Mitchell of Onslow County, NC. original will in loose papers of NC state archives Recorded in Onslow Co. Will Book A, pages 81 - 82. This will is undated, but had to have been written just shortly before 12 Aug. 1791, the date of his death. Names included: George Mitchell son - George Warren Mitchell friends - Joseph Scott Cray Reuben Grant William Jones sons not named daughters not named. Negroes mentioned but not named; The 1784-1786 State census shows 29 slaves. The 1790 Federal census shows 29 slaves. In the name of God - I GEORGE MITCHELL of Onslow County - do by this instrement appoint my good friends Joseph Scott Cray, Reuben Grant, William Jones and my son GEORGE WARREN/ soon as he may come to age of eighteen years/ my Executors, to have full power as such. 1st. to colect all the money & debts that may be due me and settle where may be due & if not suficant then to sell either at privet or publick sale such part of my estate as they may think best to discharge the same - then make a division of all my personal estate / if negros / an so could / if not they are to be encluded in as many part as may have children / nine months after my death / including my wife, then she to have her choice, which I give to her & her heirs & assigens forever. If she or as many of the children as may be of age or maryed at the above division they or either are to draw in the most eaqul manner & receive accordingly which I give to them he or she, to their heirs & assigens for ever. Then my whole estate to be kept together by keeping the negros ______? an the lands rented out or employing managers as my Exec. may think best. A division to be in like manner as all the children may come to age or marry as above which I give to them their heirs assigens for ever including if a daughter an eaqul part with all my daughters, all my lands on New River or the watters thereof also on New River Banks, reserving the plantation & sufficant timber for the use of the same, where I formly lived I ____? to my wife during her life, which lands I give to them their heirs & assigns forever. I give all my other lands to be divided in like manner to my sons as they arrive to the age of twenty one or mariage, to them their heirs & assigens forever. The divisions to be made by three unconected gentlemen chose by my executors to do eaqul right by valuation after division & then may be money given to make eaqul, the payer shall have one year paying int. & credit. If any one shall refuse to pay the money to make the other eaqul my executors are to sell giving twelve months credit paying intrest from the date as much of the refusers legesey as will discharge the same & give the bond to he or she as the case maybe. My desire is that all my children shall be educated in as good a manner as the estate will admit of without the use of the princapel. This I do acknowledge to be my last will & testement revoking all others & as my wholl ame has been to do eaqul justice by all, that none will try to destroy the same & I do not date it at present but leave it so as to take in all my children to my death or if possible nine months after, but if an acedent should happen so it should not be dated, I begg it may not be sett aside.
